1. Use of Our Services

You may use our website and services only for lawful purposes and in accordance with these Terms. You agree not to:

Violate any applicable law or regulation
Use our content or services to misrepresent, defame, or mislead others
Attempt unauthorized access to our systems or interfere with our site’s functionality

We reserve the right to deny or terminate access to anyone who misuses the platform or engages in harmful behavior.

2. Intellectual Property

All content on this website — including text, images, graphics, logos, layouts, and custom code — is the intellectual property of Mustermind Studio or its licensors. This material is protected by copyright, trademark, and other intellectual property laws.

You may not:

Reproduce, distribute, or use our content for commercial purposes without prior written consent

We reserve the right to pursue legal action against infringement.

3. Project Engagement and Deliverables

All services are governed by agreements defined in client-specific proposals or scopes of work. Projects include a predetermined number of revisions and feedback rounds. Additional changes or requirements outside of the agreed scope may result in added charges and timeline extensions.

Once final files or deliverables are approved and delivered, any subsequent change requests may incur additional costs. We do not release editable source files unless explicitly included in the agreement.

4. Payments & Billing

Clients must pay 50% of the total project fee upfront unless otherwise agreed. The remaining 50% is payable upon final delivery. All invoices must be paid within the stated time on the invoice. Late payments may result in service delays or the withholding of deliverables.

Mustermind Studio reserves the right to suspend or terminate work for accounts with outstanding payments.

5. Cancellations & Refunds

You may cancel a project at any time, but fees for services already rendered will still apply. Refunds for work in progress will be assessed based on the percentage of the project completed.

We do not offer refunds for completed work or digital goods that have been delivered. All disputes must be communicated within 7 days of delivery.

6. Third-Party Tools & Services

In some cases, we may integrate or recommend third-party tools (e.g., hosting providers, CMS platforms, or plugins). We are not responsible for the performance or security of these third-party services and advise clients to review their respective terms and privacy policies.

7. Limitation of Liability

To the fullest extent permitted by law, Mustermind Studio shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of our website, services, or deliverables.

Our total liability shall not exceed the total amount paid by the client for the specific project.

8. Confidentiality

All information shared with us in the course of a project is treated as confidential and will not be disclosed to third parties, except where required by law. We respect client privacy and intellectual property and expect the same in return.

Clients may not publicly share or claim credit for work created by Mustermind Studio without appropriate attribution, unless otherwise agreed in writing.

9. Termination

We reserve the right to terminate services and access to our platforms if a client:

Violates these Terms
Fails to make payments as agreed
Engages in unethical or illegal conduct

Upon termination, outstanding balances remain payable, and all work-in-progress may be paused or archived.

10. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved under the jurisdiction of South African courts.

11. Updates to These Terms

We may revise these Terms from time to time. Updates will be reflected on this page with a new effective date. Continued use of our website and services constitutes your agreement to the updated Terms.
